Chapter 1: General Provisions
Article 1 [Definitions]
“These Terms” or “Store Terms of Use”: These terms and conditions.
“We,” “Us,” or “Our”: The operator of this online store.
“The Service”: The e-commerce service provided by us over the internet.
“Purchaser”: A person who, after fully understanding and agreeing to these Terms and the Privacy Policy in accordance with the procedures stipulated by us, applies to purchase products.
“User”: A collective term for any person who, after fully understanding and agreeing to these Terms and the Privacy Policy, searches, views, or uses images, text, designs, logos, videos, programs, ideas, and other information (collectively, “Content”) provided through the Service.
Article 2 [Application of These Terms]
These Terms govern a User’s use of the Service provided by us via the internet. A User is deemed to have accepted these Terms at the time they begin using the Service.
Article 3 [Amendments to These Terms]
We may amend these Terms within the scope of the purpose of the Service when we deem it necessary. If a User or Purchaser uses the Service after the Terms have been amended, they are deemed to have agreed to the amended Terms.
Chapter 2: Purchase of Products
Article 4 [Purchasing Products]
Users may purchase products from us through the Service.
If a User wishes to purchase a product, the User shall apply to purchase the product in accordance with the procedures separately stipulated by us.
By clicking the button to place the order after confirming the delivery address, order details, and other information entered/registered by the User in connection with the application, and upon the User’s receipt of an email from us confirming the order details, a sales contract for the relevant product is concluded between the User and us.
Notwithstanding the preceding paragraph, if any fraudulent or inappropriate act occurs in connection with the use of the Service, we may cancel or terminate the sales contract or take other appropriate measures.
Users who are minors must obtain prior consent from a lawful statutory agent in order to purchase products through the Service.
Article 5 [Changes to Registered Information]
If there is any change to all or part of the name, address, or other matters notified to us at the time of purchase, the Purchaser shall promptly notify us. Even if a change is registered, any transactions already processed before such registration will be handled based on the information prior to the change.
Article 6 [Payment Methods]
The total payment amount for a product consists of the sales price displayed on the site plus consumption tax, shipping fees, and handling fees.
Payment for products purchased through the Service is limited to the payment methods specified by us.
If payment is made by credit card, the Purchaser shall comply with the terms and conditions of the separate agreement between the Purchaser and the credit card company. In the event of any dispute related to the use of the credit card, such dispute shall be resolved between the Purchaser and the credit card company.
If the Service specifies a payment method and the Purchaser enters into a separate agreement with the payment service provider (including but not limited to agreeing to the terms applicable to such payment method), the Purchaser shall comply with the terms and conditions of that separate agreement. In the event of any dispute related to such payment method, the dispute shall be resolved between the Purchaser and the payment service provider.
Article 7 [Returns of Products]
We will handle returns from Purchasers in accordance with the “Returns & Cancellations” section set out in the Refund Policy posted on the site.
Chapter 3: Handling of Personal Information
Article 8 [Handling of Personal Information]
We handle personal information in accordance with our separately stipulated Privacy Policy.
Chapter 4: Responsibilities When Using the Service
Article 9 [Prohibited Acts]
Users and Purchasers are prohibited from engaging in any of the following acts in connection with the use of the Service:
• Acts that cause or may cause inconvenience, disadvantage, or damage to other Users, third parties, or us.
• Acts that infringe or may infringe copyrights, trademark rights, patent rights, or other intellectual property rights, rights of likeness, moral rights, privacy rights, publicity rights, or any other rights of third parties or us.
• Acts that are or may be contrary to public order and morals, or violate laws and regulations.
• Using Content obtained through the Service beyond the scope of private use.
• Reproducing, selling, publishing, distributing, publicly disclosing, or engaging in similar acts with respect to Content obtained through the Service, either directly or through third parties other than other Users.
• Acts that interfere with the operation of the Service or other services provided by us.
• Acts that damage or undermine our credibility, or other acts that we reasonably deem inappropriate.
• Any other acts that we deem inappropriate.
Chapter 5: Disclaimers
Article 10 [Disclaimers]
We bear no responsibility whatsoever for any damage caused to third parties due to a User’s or Purchaser’s violation of these Terms.
We make no warranties of any kind regarding the completeness, accuracy, certainty, usefulness, or any other aspect of the contents of the Service or information obtained by Users or Purchasers through the Service.
As a general rule, we assume no liability to Users or Purchasers for any damages arising from the use of the Service and have no obligation to compensate for such damages. However, if the contract based on these Terms between us and a User or Purchaser constitutes a “consumer contract” as defined in Article 2, Paragraph 3 of the Japanese Consumer Contract Act (Act No. 61 of 2000) or if an exemption clause is otherwise inapplicable, any provision in these Terms that completely exempts us from liability shall not apply. Furthermore, if the contract under these Terms constitutes a consumer contract and we are liable for damages based on non-performance of obligations or tort, except in cases of willful misconduct or gross negligence by us, our liability for damages shall be limited to the total amount paid by the User or Purchaser to us under these Terms during the one-year period preceding the date on which the damage occurred.
If the Purchaser neglects or refuses to receive the product, is unable to receive the product due to prolonged absence or an unknown delivery address, or is otherwise unable to receive the product for reasons attributable to the Purchaser, we will fulfill our delivery obligation and be discharged from such obligation by contacting the contact information registered by the Purchaser and bringing or delivering the product to the delivery address specified at the time of purchase.
Chapter 6: Miscellaneous
Article 11 [Copyrights and Intellectual Property Rights]
Content provided through the Service belongs exclusively to us or to third parties holding legitimate rights. If any issue arises between a User or Purchaser and a third party due to a violation of this Article, the User or Purchaser shall resolve such issue at their own responsibility and expense and shall not cause any damage, loss, or disadvantage to us.
Article 12 [Governing Law]
All matters concerning these Terms shall be governed by the laws of Japan.
Article 13 [Consultation and Agreed Jurisdiction]
Any matters not stipulated in these Terms or any doubts arising in the interpretation of these Terms shall be resolved promptly through consultation between us and the User or Purchaser in accordance with the principle of good faith. All disputes related to these Terms shall be subject to the exclusive agreed jurisdiction of the court having jurisdiction over our location as the court of first instance.
